Joining a Polish citizen
A simplified procedure if your Polish spouse is relocating to Poland from the UK; otherwise a visa under the general rules, then a residence permit you apply for in Poland.
- Simplified procedure
- Applies to the spouse of a Polish national only if all three hold: the Polish national is relocating to Poland to live there permanently, held a residence permit for more than 3 months in the UK (or another listed state) before moving, and you married before or during that UK stay. Source
- If those conditions are not met
- You must apply for a visa under the general rules. Source
- How to apply from the UK
- Book on the e-Consulate system, which is free, and hand in your application in person at the Consular Section, 10 Bouverie Street, London. Source
- National visa fee
- 175 GBP for a national (type D) visa, paid at the appointment and not refunded if the visa is refused. Source
- Visa processing time
- The consul decides in a minimum of 15 calendar days, extended to 30 days in exceptional cases. Source
- Residence permit in Poland
- On the general rules track, you apply online on the MOS portal for a temporary residence permit as the spouse of a Polish citizen. It cannot be filed from abroad, and the stamp duty is 340 PLN. Source
- Permit decision
- Within 60 days of a complete application. The permit is granted for more than 3 months and up to 3 years. Source
- Recognised marriage
- Poland recognises a marriage only between a man and a woman. The voivode also checks the marriage is genuine. Source
- Civil and unmarried partners
- A separate permit covers civil partnerships, informal relationships and marriages Poland does not recognise. If you are abroad, your Polish partner files it on paper in Poland. Source
- Spouse relocating from the UK
- You apply in person to the voivode for a free residence card for a family member of an EU citizen, no later than the day after the end of 3 months from entry. Your spouse shows they had residence rights in the UK for more than 3 months and intend to settle in Poland. Source
- Apostille
- For the visa, certificates issued outside Poland, the EU or the UK must carry an apostille. Source
- Translation in Poland
- Documents in another language must come with a sworn translation into Polish. Source
